Terms and conditions
A – Introduction
These general conditions of sale (the only "General Conditions") govern the sale of products marketed by Giotto Service Srl, which owns the portal Wine At Home. All contracts to purchase products made through the portal and following the procedures described above, between the seller and the customer will be governed by these Terms.
B – Acceptance of the terms of sale
- The contract between Giotto S.r.l. Service and the Customer shall be construed as concluded by the acceptance, even partial, of the order by Giotto Service Srl, which reserves the right at its sole discretion, to accept the order. The tacit acceptance is deemed, unless otherwise notified by the Customer any mode. By placing an order in the manner provided, the Customer declares to have read all the information provided during the purchase procedure and accept the general conditions and payment below transcribed.
- If the customer is a final consumer (ie an individual who buys goods for purposes not related to his profession), once the procedure of buying online will save print or electronic copy, and keep still, these general conditions of sale, subject to the provisions of the Articles. 3 and 4 of Decree No 185/1999 on distance sales.
- Shall be excluded any right of the Customer to damages or compensation, and any contractual responsibility or obligation for any direct or indirect damage to persons and / or property caused by the rejection, even partial, of an order.
C – How to purchase
- The customer can buy only products in the electronic catalog of Wine At Home at the time to the order and viewable at the address (URL) http://www.wineathome.biz, as described in the related fact sheets. The technical information included in the portal Wine At Home faithfully reproduce those of the manufacturers of the goods included in the catalog. Giotto Service, therefore, reserves the right to change / adapt the technical information of products to adapt to that provided by the manufacturers without further notice. It is understood that the picture accompanying the description of a product can not be fully representative of its characteristics, and differ by color, size, accessories in the picture. All support information to be understood as a simple generic information, not related to actual characteristics of each individual product.
- Proper receipt of order is confirmed by a reply by e-mail, sent to the email address supplied by the customer. This confirmation message will report the date and time of execution and a 'number', for use in any further communication with Wine At Home. The message once again all the data entered by the customer who is committed to ensure its correctness and to communicate any corrections, as described in this document.
- In the case of non-acceptance of, Giotto Service Srl is committed to a timely notice to Customer, in the same way.
- All prices in the portal are intended retail price and, therefore, include VAT. Giotto Service S.r.l. reserves the right to change prices at any time without notice.
- In the portal Wine At Home is not visible the availability of the product at the time of ordering. Since the simultaneous access by many users-clients and the simultaneous possibility of orders online, change availability, Wine At Home does not guarantee the certainty of allocation of the goods ordered, as long as your order will not be visible.
- On certain products, subject to price promotions, Wine At Home reserves the right to accept orders by reducing the quantities, and after acceptance by the Client, failing which the order will be void.
D – Payment
The only form of payment accepted on Wine at Home is through Credit Card / Paypal. Under the conclusion of the transaction online, the reference bank shall report the transaction occurred on the current account of Giotto Service Srl and the amount of purchase.
- In case of cancellation, either by customer or in the case of non-acceptance of that part of Service Giotto, the same will require the cancellation of the transaction and the release of the amount committed. The cancellation is possible until the goods are shipped. The timing of release for certain types of cards, depend exclusively from the banking system and can reach up to their natural end (24th day after the date of authorization). Requested the cancellation of the transaction, in no event Giotto Service Srl may be liable for any damages, direct or indirect, caused by delay in release of non-committed by the banking system.
- Giotto Service S.r.l. reserves the right to request additional information to the customer (eg. number of fixed phone) or sending copies of documents proving the ownership of the paper used. In the absence of the required documents, Giotto Service Srl reserves the right not to accept the order.
- At no time of the purchase process Giotto Service Srl is in a position to know the information about the buyer's credit card, as they are typed directly on the portal of the bank that manages the transaction (with very high security systems), there is data, there is the possibility that these data are intercepted. No archive of Wine At Home contains or retains such data. In no case Giotto S.r.l. Service can therefore be held responsible for any abuse and unfair credit card by a third party, upon payment of products purchased from the Wine At Home.
E – Details and costs of delivery
- Giotto Service S.r.l. can take orders for delivery, as well as on the Italian territory, even in other countries.
- For every order made on Wine At Home, Giotto Service Srl will invoice of the material shipped. For the issuance of the invoice, are authentic to the information provided by the customer when the order. No change bill will be possible after the issuance thereof.
- The costs of shipment and delivery shall be borne by the Client and are clearly highlighted at the time of order. The payment for the goods by the Customer will be using the method of choice when. No fees or commission further is due to Giotto Service Srl
- The timing of delivery of goods to be delivered to the address the customer by courier national, will be between the fourth and the sixth working day following the date of purchase. For islands and destinations difficult delivery may require additional days. To purchase date means the day on which the payment was done regularly and that there will be reported by the bank where the account is domiciled. The time may vary for reasons of force majeure or because of traffic conditions and road conditions in general or by the Authority. The delivery standard, unless otherwise agreed in writing between the parties, will take place during the following hours: from 8.30 to 12.30, from 14.00 to 18.00, every day, no holidays, from Monday to Friday.
- No responsibility can be attributed to Giotto Service Srl in case of delay in the order or delivery of goods ordered.
- Upon delivery of the goods by the courier, the customer is responsible for:
- that the number of packages delivered corresponds to what is stated in the invoice;
- that the package is intact, not damaged or wet, or altered, even in materials of closure (strapping tape or metal). Any damage or the mismatch in the number of packages or particulars, must be immediately notified to the courier to deliver that, by adding the word "withdrawal conditional" on the accompanying document and confirmed within seven days by fax or letter ar, Giotto Service Srl - Via Lucrezio Caro 7 / A - 00193 - Roma.
- In the case of delivery by courier, the courier made its first delivery without notice. In the absence of the Customer, the carrier leaves a notice and try to deliver within 24 hours, if no further, you are left again and notice that the client must contact the courier to arrange delivery. If this is done, the goods remain in storage at the depot of the courier and must be physically removed by the customer with the payment of the costs of filing.
- For deliveries use the standard international courier service which provides for the delivery from 9:00 to 18:00 on weekdays and without notice.
F – Right of withdrawal
- According to Art. DLgs 5. N. 185/1999, if the customer is a consumer (ie an individual who buys goods for purposes not related to his professional activity, or does not indicate in the purchase order form a Wine At Home a reference to VAT) , has the right to terminate the contract of purchase for any reason, without penalty, subject as stated in paragraph 3 below.
- To exercise the right of withdrawal, the customer must send an e-mail to info@wineathome.biz which also indicates the bank needed to repay the sums paid; Giotto Service Srl send mail to the customer via a paper form to be printed, completed and returned by AR registered letter within 10 days of receipt of the goods to: Giotto Service Srl, Via Lucrezio Caro 7 / A - 00193 - Roma. Upon receiving the letter, Giotto Service will send via mail to the customer in the form of exercising the right of withdrawal provided with authorization number that must be attacked outside the housing where it will be physically located on the product and sent to Giotto Service Srl within 10 days from the authorization.

The right of withdrawal is submitted to the following mandatory conditions:
- the law applies to product purchased in its entirety, it is not possible to exercise only on the withdrawal of the product
- the property purchased must be complete and returned in original packaging, complete in all its parts. To limit damage to the packaging, and recommend, when possible, to put it in a second box, it should be avoided in all cases the application of labels or adhesive tapes on the original packaging of the product;
- shipping costs related to returning the property are charged to the customer;
- the shipment until the certificate of receipt in our warehouse is under the full responsibility of the client;
- in case of damage to the goods during transport, Wine At Home will give notice to the customer of such (within 5 working days from receipt of the goods in their stores), to enable it to make a timely complaint against the courier of his choice and obtain the reimbursement of the value of the asset (if insured), in this case, the product will be available to the client for his return, at the same time canceling the request for withdrawal;
- Giotto Service Srl does not respond in any way for damage or theft / loss of goods returned with shipments not insured;
- In case of compliance of the withdrawal by the customer, Giotto Service Srl will repay the entire amount already paid, within 14 days from the return of the goods, calls for the transfer of charge on the credit card or by bank transfer. In the latter case, by the client will provide timely manner the bank on which to obtain a refund (ABI - CAB - Account dell'intestatario the bill).

The right of withdrawal lapses completely, for lack of the essential integrity of the asset (the package and / or its content), where Giotto Service Srl finds:
- failure to affix a form of authorization issued by Giotto Service Srl the wrapping of the package shipped outside;
- the lack of external and / or the original package, internal;
- the absence of an integral product (accessories, cables, manuals, parts, ...) or defect to the product itself;
- damage to the product for reasons other than its transport.
In the case of revocation of the right of withdrawal, Giotto Service Srl will return to sender the good purchased, charging at the same shipping costs.
G – guarantees
- All products sold by Giotto Service Srl, are covered by the guarantees of the manufacturer and the warranty of 24 months for defects of conformity pursuant to Legislative Decree No 24 / 0
- To qualify for warranty service, Customer must retain the invoice you receive with the goods purchased.
- The guarantee of 24 months under the Legislative Decree n. 24/02 applies to the product with a lack of conformity, provided that the same is used correctly, respecting its intended use and as provided in the attached technical documentation. That guarantee, in accordance with the Decree. N. 24/92, is reserved only for domestic (a person who buys goods for purposes not related to his professional activity, or making the purchase without indicating in the order form a reference to VAT). In case of lack of conformity, Giotto Service Srl shall, without charge to the customer, to restore conformity of the product by repair / replacement or reduction of price, until the termination of the contract. If, after intervention by an Authorized Service Center, should not be a lack of conformity in accordance with Legislative Decree No 24/02, the Customer will be charged the cost of verification and recovery required from Licensed and transportation costs if supported by Giotto Service Srl
- Replacements in case of DOA (Dead On Arrival: not running at the first power), subject to the existence of the prerequisites for the implementation of Legislative Decree No 24/02, will be made only if expressly provided by the manufacturer. The timing of replacement or repair of any product depends solely from those indicated by the manufacturer.
- In the event that, for whatever reason Giotto Service Srl, was not able to replace a product under warranty (restored or replaced), may proceed with the consent of the client, the replacement of the product itself (if even a list) or others with the same features and value, or finally, the issue of a voucher for the same amount on another spendibile product valid for 6 months from the date of issue.
- No damage can be obtained from Giotto Service Srl for any delay in operating repair or replacement of products under warranty.
- In cases where the application of safeguards including the return of the product, the property must be returned by Customer in its original packaging, complete in all its parts (including packaging and any ancillary equipment and documentation: manuals, cables, etc ... ), to limit damage to the packaging, and recommend, when possible, to put it in a second box, must be avoided in all cases the application of labels or adhesive tapes on the original packaging of the product.

Any complaint must be addressed to Giotto Service Srl, Via Lucrezio Caro 7 / A - 00193 - Roma
I – Jurisdiction and applicable law
The contract of sale between the Client and Giotto Service Srl through the Wine At Home, made in Italy is defined and regulated by Italian Law. For the settlement of civil and criminal proceedings arising from the conclusion of this contract of sale at a distance, the jurisdiction shall be solely that of the Forum of Rome.
L – Terms
The conditions contained in this document may be modified by Giotto Service Srl without notice and will be valid from the date of publication in the Internet portal Wine At Home.
